what is the penalty for a letter carrier who lies on an appeal for workers comp?
There are witnesses, audio tapes of him admitting to drug abuse on the job, admitting to shoveling snow (the claim is for a back injury), trying to coerse someone to say if asked, that it was them that shoveled snow, and video tapes that blantantly exhibit him shoveling, throwing snowballs swinging baseball bats and lugging groceries?
Well the work comp company will submit the evidence to a fraud unit and then the fraud unit will submit the evidence to the state district attorney.
Some DA’s will take the case while other don’t as it doesn’t meet a certain tort amount. In most cases some people go to jail for a year while others don’t go to jail at all and is ordered to pay back money. So there really is no answer for it. It just depends on the jury.
